Section 405 of the Indian Penal Code (IPC), 1860, defines Criminal Breach of Trust. According to this section, the offense occurs when a person who is entrusted with property (or dominion over it) dishonestly misappropriates it, converts it to their own use, or uses/disposes of it in violation of a legal direction or contract.
- Section 403: Defines "Dishonest misappropriation of property", which differs from breach of trust as it does not necessarily require prior entrustment.
- Section 415: Defines "Cheating".
- Section 410: Defines "Stolen property".
It is important to note that with the implementation of the Bharatiya Nyaya Sanhita (BNS), 2023, which replaced the IPC, the definition of Criminal Breach of Trust is now contained in Section 316.
