Between August 15, 1947, and January 26, 1950, India functioned as a dominion within the British Commonwealth [3]. During this interim period, the Indian Independence Act of 1947 provided the legal framework for the transfer of power and the creation of two independent dominions [5]. Specifically, Section 8 of the 1947 Act stipulated that the government of each dominion would be carried out, as nearly as possible, in accordance with the Government of India Act, 1935 [6]. While the 1947 Act granted the Constituent Assembly full sovereign legislative powers to modify the existing framework, the 1935 Act remained the functional governing statute until the new Constitution of India was formally adopted and enacted in 1950 [2].
