The Tenth Schedule of the Constitution of India contains provisions regarding anti-defection. It was added to the Constitution by the 52nd Amendment Act of 1985. The main objective of the Tenth Schedule is to curb political defections by the elected representatives. It lays down the process and grounds for disqualification of a member of Parliament or a state legislature for changing party loyalties. The anti-defection law prohibits an elected member from voluntarily giving up the membership of his/her party or from voting against the party’s official candidate on any issue that is put to vote in the house. Any violation of the provisions of the Tenth Schedule may lead to disqualification of the member concerned.
