Explanation
Under Section 5 of the Industrial Disputes Act, 1947, the appropriate Government may constitute a Board of Conciliation for promoting the settlement of industrial disputes. According to Section 5(2) of the Act, the Board shall consist of a Chairman and two or four other members, as the Government thinks fit.
- The Chairman must be an independent person.
- The other members are appointed in equal numbers to represent the parties to the dispute (employers and employees).
- These representative members are appointed on the recommendation of the respective parties they represent.
The primary duty of the Board is to investigate the dispute and do all such things as it thinks fit for the purpose of inducing the parties to come to a fair and amicable settlement.
