The declaration of Constitutional Emergency in an Indian State has to be approved by the Parliament within a period of 2 months. A Constitutional Emergency is declared under Article 356 of the Indian Constitution when the President believes that the governance of a state cannot be carried out in accordance with the provisions of the Constitution. This declaration gives the President the power to dismiss the state government and assume direct control of the state. However, this declaration is not permanent and needs to be approved by the Parliament within a specific time frame. In this case, the Parliament has to approve the declaration within 2 months. If the Parliament fails to do so, the declaration automatically lapses and the state government is reinstated.
